Karen (Zhenkun) Liu, Head of Corporate and Fund Formation at Reid & Wise, authored an article published at American Bar Association entitled, “What Investment Advisers Can Learn from the 2024 Marketing Rule Risk Alert.” The article reviews a Risk Alert newly issued on April 17, 2024 by the SEC's Division of Examinations sharing the staff's initial observations from their real-life examinations of investment advisers' compliance with amended Rule 206(4)-1 under the Investment Advisers Act of 1940. The observations focus on advisers' compliance with Marketing Rule–related aspects of Advisers Act Rule 206(4), Advisers Act Rule 204-2, and the Marketing Rule's “General Prohibitions,” as well as accurate disclosure of their Marketing Rule compliance in Form ADV. Karen shed light on the itemized illustrations provided by the observation to investment advisers, which can help them understand how to better comply with the Advisers Act's antifraud rules in their day-to-day advertising practices. BREAKING NEWS, United States Citizenship and Immigration Services (USCIS) has approved its first-ever Form I-526E for a rural EB-5 project investor under the EB-5 Reform and Integrity Act of 2022 (the “2022 RIA”). “Sophie” Yuxia Zhang, Esq from Reid & Wise served as the EB-5 investor’s immigration counsel. This momentous achievement not only highlights Reid & Wise's exceptional legal representation of EB-5 investors but also underscores the advantages of investing in reserved EB-5 projects, including expedited processing and set-aside visas. As one of the earliest I-526E petitions filed under the rural EB-5 project within the 2022 RIA, the current EB-5 I-526E petition was submitted on August 25, 2022. In less than 11 months, on July 18, 2023, the I-526E petition received approval without any Request for Evidence (RFE). In the past, the adjudication process for EB-5 I-526 petitions had been notoriously protracted, with USCIS processing times averaging around 56.5 months for 80% of cases. However, this unprecedented approval of the I-526E petition in just 11 months highlights the unparalleled opportunity for both EB-5 investors and projects to benefit from priority processing, particularly in rural projects. Reid & Wise has built a stellar reputation for successfully representing EB-5 investors in immigration matters and was instrumental in assisting these investors in demonstrating the source of their funds in I-526E petitions. Matthew Sava, head of litigation at Reid & Wise LLC, was invited to speak at the 9th World Litigation Forum, held in Amsterdam on July 2, 2019. For his prepared remarks, Matthew discussed the international enforcement of court judgments and arbitration awards, reviewing the principal instruments governing each system and their relative advantages and disadvantages. Matthew surveyed different approaches across the globe, with particular emphasis on the enforcement regimes in the United States and China. Matthew served on a panel with lawyers from Italy, Switzerland and the Cayman Islands, leading to a lively and informative debate. The World Litigation Forum is attended by litigation experts from around the world and provides a forum for leading practitioners to exchange ideas and to shape the global litigation discourse.
Matthew Sava was invited to discuss the state of EB-5 investment litigation at the 11th Annual IIUSA EB-5 Advocacy Conference on April 23, 2018 in Washington, D.C. Joining with other leading EB-5 practitioners on the panel, Matthew discussed the comprehensive approach to resolve EB-5 Investment-related disputes, stressed the importance of the roles of the regional centers and managers of EB-5 projects to keep the process of redeployment of EB-5 investment funds transparent, and discussed ways that investors may exercise their voting right and take activist actions to protect their limited partnership interest while their immigration petitions are pending for approval. Lawyers, bankers, fund managers, and EB-5 regional centers from the U.S. and abroad attended this three-day-conference to discuss and learn about the latest trends in the EB-5 Investment and Immigration industry.
After a hard-fought, three-year court case, Reid & Wise prevailed in a trial in the United States District Court for the Eastern District of New York and helped the client retain her ownership interest in a property valued at more than $5 million. The case involved a dispute over the ownership of property. The plaintiff claimed that Reid & Wise’s client was not the true owner of the property and brought this lawsuit against the client to try to deprive the client's ownership interest in this property. After a 3-day trial, the Court read its decision into the record, rejecting all of the plaintiffs’ claims and ruling in favor of our client. Matthew Sava made a presentation on EB-5 litigation issues at a seminar entitled, "The EB-5 Program Reform: What Your Firm Should Be Aware of In 2017," on May 17, 2017. For his presentation, Matthew reviewed the types of claims frequently encountered in EB-5 lawsuits, reviewed SEC enforcement trends, and provided practical guidance on the steps to take to mitigate litigation risks. Matthew was joined on the panel by other leading EB-5 practitioners.
On Monday evening May 10, 2017, Reid & Wise’s partner Shiyong R. Ye was invited by Bill De Blasio, Mayer of the City of New York, and Chirlane McCray, First Lady of the City of New York, to join the celebration of the Asian Pacific American Heritage month at Gracie Mansion, the Mayer’s residence along the East River. Mr. Ye has been invited to the Mayer’s mansion multiple times as one of the representatives of Asians in America. The reception party was joined by leaders in Asian-Pacific community in New York in celebrating the impact and the influence of Asian-Pacific American community.
